By using TRACKMOND you agree to these terms. The most important points are: the app is a monitoring tool and not a replacement for medical care, your hospital handles enrolment and billing, disputes go through internal resolution first, and Nigerian law governs this agreement. Please read the medical disclaimer in Section 3 carefully.
Agreement to Terms
By downloading the TRACKMOND application, creating an account, accessing the hospital dashboard, or using any feature of the service, you enter into a binding legal agreement with TRACKMOND and agree to these Terms of Service in full.
If you do not agree with any part of these terms, you must not use the service.
These terms are between you and Trackmond Health LTD (Companies House number 17060070), registered in England and Wales at 3 Bowring Close, Bristol, BS13 0DH, United Kingdom, referred to as "TRACKMOND".
We reserve the right to update these terms. We will notify you of material changes at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.
The Service
TRACKMOND provides a remote patient monitoring platform for individuals living with hypertension, diabetes, or both. The service enables patients to log health readings, receive personalised insights, and share real-time data with their linked doctor or hospital.
The service currently comprises the following components.
- An Android mobile application for patients to log blood pressure and blood glucose readings, track medications, and interact with an AI health coach.
- A hospital dashboard accessible by doctors, nurses, and hospital administrators to monitor patient readings, receive alerts, and generate clinical reports.
- An AI health coaching feature that uses the patient's recent health data to generate contextually relevant responses.
- Push notifications and SMS alerts delivered when readings fall outside safe ranges.
TRACKMOND is available on Android and iOS.
We reserve the right to modify, suspend, or discontinue any feature of the service at any time. We will provide reasonable notice of significant changes wherever possible.
Medical Disclaimer
TRACKMOND is a monitoring and communication tool. It is not a medical device, a clinical diagnostic system, or a substitute for professional medical advice, diagnosis, or treatment. Nothing on the platform or generated by the AI coach constitutes medical advice. Always seek the guidance of your doctor or a qualified healthcare professional before making any changes to your medication, treatment, or health routine.
In any medical emergency, call 112 immediately or go to your nearest emergency department. Do not rely solely on TRACKMOND alerts or notifications during a health crisis.
TRACKMOND does not guarantee that your linked doctor or hospital will respond to any reading within a specific timeframe. Response times depend entirely on the clinical staff and institution you are registered with. TRACKMOND is not liable for any clinical decisions made, or not made, by your care team.
The platform is intended for adults aged 18 and above who are monitoring hypertension or diabetes. It is not intended as a diagnostic tool, a substitute for in-person consultations, or a device for managing acute medical emergencies.
Accounts and Eligibility
To use TRACKMOND you must be at least 18 years of age and provide accurate, truthful, and complete registration information.
- You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with anyone.
- You are responsible for all activity that occurs under your account, whether or not you authorised it.
- If you suspect that your account has been accessed without your permission, notify us immediately at support@trackmond.com.
- You must update your account information promptly if any details change, particularly your phone number or linked hospital.
- We reserve the right to suspend or terminate accounts that provide false information, violate these terms, or engage in conduct that harms other users or the platform.
Enrolment and Billing
Patients are enrolled in TRACKMOND by their hospital. Your hospital is responsible for activating your account and for any fees associated with the service. We do not charge patients directly.
The TRACKMOND patient app contains no payment screens. We never ask patients for card details, bank details, or any other payment information. If you are ever asked to pay anything inside the app, do not enter any details and contact us at support@trackmond.com.
Hospitals enter into a separate billing agreement with TRACKMOND that governs platform fees, payment terms, and refunds at the institutional level. If your hospital ends your enrolment, you will lose access to the app — speak to your hospital if you have questions.
Acceptable Use
By using TRACKMOND you agree not to engage in any of the following.
- Entering false, fabricated, or deliberately misleading health readings into the app.
- Attempting to access accounts, records, or parts of the system you are not authorised to access.
- Using the platform to harass, threaten, or intimidate other users or staff.
- Attempting to reverse engineer, decompile, copy, or redistribute the app, dashboard, or any proprietary content.
- Uploading viruses, malware, or any code designed to disrupt the service or harm other users.
- Using the platform for any purpose that is unlawful under Nigerian or UK law.
- Attempting to circumvent access controls or impersonate another patient or hospital staff member.
Violations of this section may result in immediate account suspension without refund and, where conduct is criminal in nature, referral to the appropriate authorities.
Hospital and Staff Accounts
Doctors, nurses, and administrators who access the TRACKMOND hospital dashboard agree to the following additional terms.
- You are authorised by your employing institution to access the platform and the patient data associated with that institution.
- Patient data accessed through the dashboard must be used solely for the clinical care of those patients and in compliance with Nigerian data protection law and applicable medical ethics standards.
- Individual login credentials must not be shared between staff members. Each staff member must use their own account.
- You must notify TRACKMOND and your institution immediately if you suspect that any patient data has been accessed by an unauthorised person.
- Hospitals are responsible for ensuring that all staff members who use the dashboard are trained, authorised, and aware of their data protection obligations.
TRACKMOND reserves the right to terminate hospital dashboard access if any staff account is found to be misusing patient data or operating outside the bounds of these terms.
Artificial Intelligence Features
TRACKMOND offers AI-powered features provided through Claude AI by Anthropic PBC (450 Mission Street, San Francisco, CA 94105, USA). These features include AI Coach, Health Insights, Reading Interpretation, Symptom Assessment, Adherence Coaching, Weekly Health Summaries, and Photo Verification. Patient accounts are limited to 5 AI interactions per day; hospital admin accounts are limited to 50 per day. No conversation history is retained between sessions.
Each message you send is processed with your recent health readings, active medications, and basic profile (first name, age, and gender) as context. Data is transmitted to Anthropic over encrypted HTTPS. No conversation history is retained by TRACKMOND or Anthropic between sessions.
Informational use only. AI-generated content is for informational and educational purposes only. AI outputs do not constitute medical advice, diagnosis, treatment, or clinical recommendations of any kind. You should always consult a qualified healthcare professional before making any decision about your health, medication, or treatment.
No reliance in emergencies. You must not use or rely on AI features during a medical emergency. In any emergency, call 112 immediately or go to your nearest hospital.
Limitation of liability. TRACKMOND, Anthropic, and their respective affiliates are not responsible for any decision, action, or harm arising from sole reliance on AI-generated content. Your use of AI features is at your own risk and does not create a clinical relationship of any kind. TRACKMOND applies content filters to prevent the AI from responding to requests outside its health monitoring remit. Attempts to override, jailbreak, or redirect the AI coach will be blocked and logged.
Consent and control. AI features are activated only with your explicit consent, obtained before you access any AI feature. You may withdraw consent at any time via Profile → Settings → AI Health Features in the app. Withdrawing consent disables all AI features immediately and stops further sharing of your health data with Anthropic. Your Data and Exports
You retain ownership of the health data you enter into TRACKMOND. By using the service, you grant us a limited, non-exclusive licence to store, process, and display that data to deliver the service to you and your care team.
Patient data exports. Authorised hospital staff may export patient health records from the dashboard in CSV format. Exported data is governed by the hospital's own data protection obligations. TRACKMOND is not responsible for how exported data is handled once it leaves the platform.
Account deletion. You may request deletion of your account and all associated personal data at any time by contacting support@trackmond.com. Data will be deleted within 30 days, subject to legal retention requirements. See our Privacy Policy for full details.
Intellectual Property
The TRACKMOND name, logo, application, hospital dashboard, website, and all associated content including but not limited to design, code, text, and data models are the exclusive property of Trackmond Health LTD, protected by Nigerian and UK copyright, trademark, and intellectual property law.
You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the platform without prior written consent from TRACKMOND.
Nothing in these terms transfers any intellectual property rights to you. Your only right is to use the service as permitted under these terms.
Limitation of Liability
To the maximum extent permitted by applicable law, TRACKMOND shall not be liable for any of the following.
- Indirect, incidental, consequential, or special damages arising from your use of, or inability to use, the service.
- Clinical decisions made or not made by your linked doctor, nurse, or hospital in response to your readings.
- Any health outcome resulting from reliance on AI-generated coaching responses.
- Service interruptions, downtime, or data loss caused by circumstances outside our reasonable control, including but not limited to internet outages, third-party service failures, or force majeure events.
- Unauthorised access to your account resulting from your failure to maintain the security of your credentials.
Our total aggregate liability to you for any claim arising from or related to the service shall not exceed the total amount you paid to TRACKMOND in the three calendar months immediately preceding the event giving rise to the claim.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded under Nigerian or UK law.
Dispute Resolution
We encourage all disputes to be resolved through direct communication before any formal proceedings are initiated. If you have a complaint or concern, please contact us first at support@trackmond.com. We will acknowledge your complaint within 5 business days and work in good faith to reach a resolution within 30 days.
If a dispute cannot be resolved through internal resolution within 30 days, either party may escalate the matter to formal proceedings under the governing law set out in Section 14.
For disputes relating to data protection specifically, you also have the right to refer the matter directly to the Nigeria Data Protection Bureau or the UK Information Commissioner's Office, as described in our Privacy Policy.
Termination
You may close your account at any time by contacting support@trackmond.com or by speaking to your hospital.
TRACKMOND may suspend or terminate your account immediately and without notice if you violate these terms, engage in fraudulent activity, or take actions that threaten the security, integrity, or reputation of the platform or its users.
On termination of your account for any reason, your right to access the service ends immediately. Sections covering the medical disclaimer, intellectual property, limitation of liability, dispute resolution, and governing law survive termination and remain in full force.
Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes that cannot be resolved through the process in Section 12 shall be subject to the exclusive jurisdiction of the courts of Nigeria.
If you are ordinarily resident in the United Kingdom, these terms shall be governed by the laws of England and Wales, and any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
